Introduction
Beyond Guard ("Beyond Guard," "we," "our," or "us") is committed to protecting the privacy and security of personal information entrusted to us. This Privacy Policy describes how we collect, use, store, disclose, transfer, and safeguard information when individuals access or use our website, platform, APIs, products, services, and any related offerings (collectively, the "Services").
By accessing or using the Services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with the practices described herein, you should not access or use the Services.
1) Information We Collect
We collect information from a variety of sources in order to provide, maintain, secure, and improve our Services. Information may be provided directly by users, collected automatically through the operation of our Services, or obtained from third parties acting on behalf of users or organizations.
Information provided directly by users may include personal and business contact details such as names, company names, job titles, email addresses, telephone numbers, billing information, account credentials, support requests, communications with our team, and information submitted through forms, demos, surveys, webinars, or other interactions with Beyond Guard.
In the course of providing our Services, we may also process information and content submitted by customers and authorized users. This may include prompts, inputs submitted to artificial intelligence systems, outputs generated by artificial intelligence systems, uploaded documents, configuration settings, security events, threat indicators, system logs, metadata, and other content processed through the platform ("Customer Content"). Customers remain responsible for the content they submit to the Services and retain ownership of their Customer Content unless otherwise agreed in writing.
We also automatically collect certain technical and usage-related information when users access our Services. Such information may include IP addresses, browser characteristics, operating system details, device identifiers, session information, referral URLs, pages viewed, interactions with platform features, timestamps, performance metrics, diagnostic data, security telemetry, and log information. This information helps us operate the Services, troubleshoot issues, improve performance, and maintain security.
Additionally, we may use cookies, local storage technologies, analytics tools, pixels, and similar technologies to support platform functionality, improve user experience, measure service performance, analyze usage trends, and protect our Services against abuse, fraud, or unauthorized activity. Users may control certain cookie preferences through browser settings, although disabling some technologies may affect the availability or functionality of certain Services.
2) How We Use Your Information
We use collected information for legitimate business and operational purposes related to providing and improving our Services. Information may be used to establish and manage accounts, authenticate users, process transactions, provide customer support, respond to inquiries, communicate important service-related information, and administer contractual relationships with customers.
Information may also be used to improve platform functionality, develop new features, monitor system performance, perform analytics, evaluate service effectiveness, maintain operational reliability, and enhance user experience. We may further use information to protect the integrity and security of our Services, investigate suspicious activity, prevent fraud, enforce our agreements and policies, comply with legal obligations, and safeguard the rights, property, and safety of Beyond Guard, our customers, and third parties.
3) AI Processing and Security Monitoring
Beyond Guard provides artificial intelligence security, governance, monitoring, and risk management solutions. As part of these Services, Beyond Guard may process prompts, model inputs, model outputs, metadata, security events, system interactions, behavioral indicators, and related information for purposes including threat detection, prompt injection detection, jailbreak detection, data leakage prevention, policy enforcement, security monitoring, abuse prevention, incident response, compliance reporting, and service administration.
Where applicable, Beyond Guard may analyze interactions with AI systems to identify malicious activity, security vulnerabilities, policy violations, or operational risks. Such processing is performed solely to provide and improve the Services, maintain platform security, investigate incidents, and fulfill contractual obligations.
Unless expressly authorized by a customer through a separate written agreement, Beyond Guard does not use Customer Content to train general-purpose artificial intelligence models or publicly available foundation models.
4) Legal Bases for Processing
Where applicable data protection laws require a legal basis for processing personal information, Beyond Guard processes such information based on one or more lawful grounds. These grounds may include the necessity of processing for the performance of a contract, compliance with legal obligations, the pursuit of legitimate business interests, protection of vital interests, or the consent of the individual where consent is required by law.
Our legitimate interests may include operating and improving our Services, maintaining security, preventing fraud, conducting business operations, protecting legal rights, and supporting customer relationships in a manner that does not override applicable privacy rights and freedoms.
5) Disclosure of Information
Beyond Guard may share information with trusted service providers and contractors who perform services on our behalf. These service providers may support functions such as cloud hosting, infrastructure management, analytics, payment processing, customer support, communications, monitoring, security operations, and other operational activities necessary to provide the Services. Such parties are authorized to access information only to the extent reasonably necessary to perform services for Beyond Guard and are required to maintain appropriate confidentiality and security measures.
Depending on customer configurations and integrations, information may also be transmitted to third-party technology providers, cloud infrastructure providers, artificial intelligence service providers, or other authorized platforms utilized in connection with the Services. Such providers may include large language model providers, cloud service providers, or technology partners selected by customers or required for the operation of specific platform features.
We may disclose information when required to do so by applicable law, regulation, court order, governmental request, or legal process. Disclosure may also occur when we believe in good faith that such action is necessary to investigate fraud, respond to security incidents, enforce contractual rights, protect public safety, defend legal claims, or protect the rights, property, and security of Beyond Guard, our customers, or other individuals.
In the event of a merger, acquisition, financing transaction, corporate restructuring, bankruptcy proceeding, sale of assets, or similar business transaction, information may be transferred as part of the transaction subject to applicable legal requirements.
6) International Data Transfers
Beyond Guard operates internationally and may process information in countries other than the country where the information was originally collected. As a result, information may be transferred to and processed in jurisdictions that may have data protection laws different from those in a user's country of residence.
Where required by applicable law, Beyond Guard implements appropriate safeguards designed to protect personal information during international transfers. Such safeguards may include contractual commitments, recognized transfer mechanisms, and organizational measures intended to ensure an appropriate level of protection for transferred information.
7) Data Retention
Beyond Guard retains information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, provide the Services, comply with contractual obligations, maintain security records, resolve disputes, enforce agreements, and satisfy applicable legal, regulatory, tax, accounting, or compliance requirements.
Retention periods may vary depending on the nature of the information, customer configurations, applicable legal obligations, and operational requirements. Following the expiration of applicable retention periods, information may be securely deleted, anonymized, aggregated, or otherwise rendered incapable of identifying an individual.
8) Data Security
Beyond Guard maintains administrative, technical, physical, and organizational safeguards designed to protect information against unauthorized access, disclosure, alteration, loss, misuse, or destruction. These safeguards may include access controls, encryption technologies, monitoring systems, authentication mechanisms, vulnerability management processes, employee training programs, and incident response procedures.
Despite our efforts to implement and maintain commercially reasonable security measures, no method of transmission over the Internet or method of electronic storage can be guaranteed to be completely secure. Accordingly, Beyond Guard cannot guarantee absolute security and users acknowledge that information is provided at their own risk.
9) Individual Rights
Depending on the jurisdiction in which an individual resides, applicable privacy laws may provide certain rights regarding personal information. Such rights may include the right to access personal information, request correction of inaccurate information, request deletion of information, object to certain processing activities, restrict processing, request data portability, withdraw previously granted consent, or submit complaints to relevant supervisory authorities.
Beyond Guard will evaluate and respond to requests in accordance with applicable legal requirements and may require verification of identity before processing certain requests.
10) Children's Privacy
The Services are intended solely for business, professional, and organizational use and are not directed toward individuals under the age of eighteen. Beyond Guard does not knowingly collect personal information from children. If we become aware that personal information has been collected from a child in violation of applicable law, we will take reasonable steps to delete such information promptly.
11) Third-Party Websites and Services
